{"id":1928,"date":"2019-12-02T16:36:06","date_gmt":"2019-12-02T16:36:06","guid":{"rendered":"https:\/\/delaneysilva.com\/blog\/?p=1928"},"modified":"2019-12-09T19:16:35","modified_gmt":"2019-12-09T19:16:35","slug":"apple-inc-vs-fbi-privacy-vs-security","status":"publish","type":"post","link":"https:\/\/delaneysilva.com\/blog\/apple-inc-vs-fbi-privacy-vs-security\/","title":{"rendered":"Apple, Inc. vs. FBI: Privacy vs. Security?"},"content":{"rendered":"\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-flow wp-block-group-is-layout-flow\">\n<p class=\"has-text-align-left wp-block-paragraph\">The <em>writ<\/em> that orders Apple to unblock a cellphone \u2014 by \nrequest of the Federal Bureau of Investigations (FBI) \u2014 and Apple\u2019s \nrefusal to comply, has shined the spotlight once again on the debate of \nwhich fundamental right should prevail: Security or Privacy.<\/p>\n<\/div><\/div>\n\n\n\n<p class=\"wp-block-paragraph\"> On February 16th, Magistrate Judge Sheri Pym ordered the technology  giant to provide the FBI with \u201creasonable technical assistance\u201d to  unblock the iPhone of one of the San Bernardino shooters, Syed Rizwan  Farook, so that the FBI can continue their criminal investigation and  verify whether the device contains information regarding the planning of  the shooting. Apple refuses, arguing that said technology doesn\u2019t  exist. Moreover, in order to comply with the court order, Apple would  have to create a new operating system specifically designed to  circumvent iPhones\u2019 security features, which would put at risk the  privacy and personal information of millions of iPhone users around the  world.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Apple\u2019s arguments are simple. On the one hand, it is being asked to  give something that it does not have, since this system doesn\u2019t  currently exist, and thus compliance with the court is materially  impossible. And on the other, if the order was for Apple to design this  system, there would be no way to comply without potentially violating  the privacy rights of millions of other people. That is to say, the  implications go beyond this particular case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The arguments of the FBI are equally simple. Apple is not being asked\n to unblock all the iPhones in the world, but one in particular that is \nin possession of the government, whose owner is dead and no longer has \nprivacy rights. Additionally, the FBI request was made with the purpose \nof cooperating with a criminal investigation that may ultimately save \nthousands of lives. It is a matter of national security.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Apple\u2019s CEO, Tim Cook, said that although, technically, it is \npossible for Apple to design this new operating system, its creation is \nsimply \u201ctoo dangerous\u201d, and basically Apple itself is being asked to \nfind the way to hack the millions of iPhones that currently exist, all \nof which contain personal information of its users. Automatically, there\n would be a \u201cback door\u201d to unlock any iPhone in case the system falls \n\u201cin the wrong hands\u201d. Although the FBI says it would only be used for \nthis specific case, there is no way to guarantee it.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-style-default is-layout-flow wp-block-quote-is-layout-flow\"><p><strong>&#8220;The final ruling of the courts will set forth a precedent [ &#8230; ] of whether the duty of the government to guarantee the collective security of its citizens outweighs the right of each citizen to their individual privacy.&#8221;<\/strong><\/p><\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">In a pleading filed as a response to Apple\u2019s objection to the court \norder, the Justice Department said that Apple only seeks to protect its \nsales, and that the marketing interests of one sole company are being \nplaced before the national security of the United States.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The truth is that the result of this debate goes further than  Farook\u2019s cellphone. The final ruling of the courts will set forth a  precedent not only of whether the duty of the government to guarantee  the collective security of its citizens outweighs the right of each citizen to their individual privacy, but also on how much a company can grow for  the courts to consider that protecting this one company\u2019s customers is  the same as protecting society as a whole. Ironically, in this case it  seems that it is Apple who is standing up in the defense of the rights  of individual citizens, and not the government.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This case is expected to be taken all the way up to the U.S. Supreme Court.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-full\"><img data-recalc-dims=\"1\" loading=\"lazy\"
